Modes of Acquisition of Nationality

A. BY BIRTH
In accordance with the principle of ‘Jus Soli’, every child by birth is the national of the state where he takes birth.

For instance, in UK & USA, the children of foreign parents born on their territories are recognized as nationals. Similar, is the case in Argentina where the territory of birth acts as decisive factor in ensuring acquisition of nationality.

B. NATURALIZATION
A foreigner may be able to acquire nationality of other state by adopting any of the means that come under naturalization. It can be in any of the following modes;

  • Marriage with Foreigner
  • Acquisition of Domicile of other State
  • Appointment as Government Official
  • Applying for Acquisition of Nationality

C. RESUMPTION/REINTEGRATION
The persons who are natural born nationals of a state and have lost their nationality due to certain reasons may apply for resuming the nationality under this mode.

D. SUBJUGATION
In case a state’s territory is conquered by the other then its nationals will ipso facto acquire the nationality of the state which has conquered it.

E. CESSION
In case a state ceases to exist and disintegrates in a number of new states then residents of the state ceded will acquire the nationality of the new state or the state which has ceded its territory. For example, the states emerged after USSR got disintegrated granted new nationalities to the inhabitants.
